Can I file bankruptcy more than once?

 

Typically, an individual can only file for bankruptcy protection once every eight(8) years. However, what the courts are really looking at is whether you received a discharge from your debts within the last eight years.

We have represented a number of individuals who in the last three to four years have actually needed to file bankruptcy several times but never received a discharge. As long as you were making those filings for legitimate purposes and not abusing the court system, you will still be allowed to file again and then seek the discharge at that time.
