What is the Means Test?

In order to file a Chapter 7 bankruptcy, we must determine whether you satisfy what is called the Means Test. This is an additional requirement that congress enacted in 2005, and what they want to ensure is that the amount of household income that you have is not in excess of the average household income in the same area in which you live. If it is you will likely need to file a chapter 13 bankruptcy which means that we will reorganize your debts. If it is below that amount and typically that amount is in the range of approximately $5,000 gross per month. If it’s below that amount, then you will be entitled and allowed to file a Chapter 7 bankruptcy, which means that you’ll be able to get rid of all those debts.

What Types of Debt are involved in Bankruptcy?

There are typically two types of debts involved in a bankruptcy, secured debts and unsecured debts.

Secured debts are those that are tied to a particular type or piece of property. So, home loans are secured, car loans are secured, certain debts with companies such as RC Willey, the refrigerator or the plasma screen TV that you bought may be a secured debt. In those circumstances, the creditor cannot require you to continue to make the payment to them after you’ve filed bankruptcy but they are allowed to come in and take that secured property back. So, we will help you decide what you are able to afford and ways that we can work with these creditors to best suit your needs.

Most student loans will not disappear unfortunately as a result of filing for bankruptcy protection. There are exceptions to that rule. What do I need in order to file Bankruptcy?

Before filing a bankruptcy, you need to be able to communicate to us “who it is that you owe money to”, whether they are currently taking action against you to enforce those debts, or if they are simply creditors that you might be paying on a regular basis.

In a bankruptcy, we have to list all of those creditors. You cannot pick and choose which ones you want to file against, so we need that information, we need your information related to your taxes, we need information related to your income and the assets that you own.

If you are in the middle of a divorce proceeding and your ex-spouse, or ex-spouse to be ends up filing for bankruptcy her obligation, or his, on the debts that they have incurred, in most cases will completely disappear unless they are responsible for child support payments. Once those debts disappear you will be the sole responsible party libel for those debts and in our office we often see individuals who must file bankruptcy on their own simply because their spouse or ex-spouse forces them into making that decision.

What is a Chapter 13 Bankruptcy?

A Chapter 13 bankruptcy filing is a re-organization bankruptcy filing. What that means is, you have certain debts and rather than being allowed to make those debts completely disappear you are re-organizing those debts and paying a certain amount on the dollar on those debts.

So, for example, you may have a total of $150,000 that you owe to various creditors including your home and by filing the Chapter 13 case, if you are behind on certain payments, if you need to have a reduction on certain payments, then that bankruptcy will typically allow you to reduce those payments and extend the amount of time that they can be paid.

Which Bankruptcy Chapter should I file?

Your options for the different types of bankruptcies you can file are limited between a Chapter 7, a Chapter 13, and in very limited circumstances, a Chapter 11.

If you make in excess of the average income for your family size and for the location where you live then you will need to file a Chapter 13 and reorganize a portion of your debts. Otherwise, you will be able to qualify for a Chapter 7, the advantage being that you get rid of those debts as opposed to reorganizing and paying on a portion of those debts in a Chapter 13.

In many cases, filing bankruptcy will actually help you restore credit. As part of the process that we do when filing bankruptcy, we will run a credit report for you and that credit report on the first page will actually show you what your expected credit score will be 12 months from now as opposed to what it is today and it is often higher in 12 to 24 months than it is today because your 30 and 60 and 90 day lates, collection efforts, things of that nature go away.
